Kazakhstan’s Constitutional Court: Safeguarding Rights and Ensuring Justice for All

In a significant move towards enhancing citizen rights and upholding the rule of law, Kazakhstan re-established its Constitutional Court last year following constitutional amendments in 2022. This pivotal milestone marked the government’s commitment to strengthening mechanisms for citizen protection and ensuring the comprehensive provision, observance, and enforcement of the country’s Constitution.

The Constitutional Court, consisting of 11 judges, plays a crucial role in scrutinizing laws and normative legal acts to ensure compliance with the country’s Constitution, known as the Basic Law. By ensuring that all laws align with the fundamental principles and values enshrined in the Constitution, the Court safeguards the legal framework within which the country operates, preventing arbitrary governance and protecting the rights and freedoms of citizens.

Unlike its predecessor, the Constitutional Council, the Court now allows every citizen to appeal, including the Commissioner for Human Rights and the Prosecutor General. The surge in appeals from citizens over the past year, totaling over 6,700 appeals, highlights the value of the Court in protecting citizen rights and aligning legislative acts with the Constitution.

In addition to handling appeals, the Court actively engages in educational initiatives to enhance public awareness and understanding of its role and functions. By organizing seminars, conferences, and panel discussions, the Court fosters a dialogue with the community it serves, ensuring a broader comprehension of its judicial activities and responsibilities.

The Court’s decisions and recommendations are binding on state bodies and officials, guaranteeing that all governmental actions adhere to the highest legal standards set forth in the Constitution. These decisions play a crucial role in shaping the legal culture, guiding judicial practice, and promoting a fair and democratic legal system.

Furthermore, collaboration with international organizations such as the Venice Commission of the Council of Europe and the Eurasian Association of Constitutional Control Bodies is essential to enhance constitutional governance and adapt to global legal trends and challenges. This commitment to international collaboration also extends to making constitutional knowledge accessible to all citizens, including visually impaired individuals through the publication of the updated Kazakh Constitution in Braille.

Ultimately, the Constitutional Court’s adherence to legality, stability, and the rule of law is vital for upholding individual rights and maintaining a stable legal environment essential for economic growth and democratic governance.
