The gig economy, a rapidly growing sector in urban India, offers flexibility and autonomy to workers across various industries. However, the lack of regulatory framework to protect gig workers’ rights has raised concerns about their basic amenities and legal protections.

Currently, India ranks fifth in the world for gig workers, with approximately 15 million skilled individuals engaged in freelance work. Experts predict a growth rate of 17% annually, reaching an estimated value of $455 billion by 2024. Despite this growth, gig workers at the bottom of the pyramid face challenging conditions, including long working hours, inadequate earnings, and high levels of physical and mental stress.

From a legal perspective, the Code on Social Security, 2020, defines gig workers as individuals who engage in temporary or short-term work arrangements independently. However, the Industrial Relations Code, 2020, does not provide gig workers with the same rights and protections as traditional employees.

The legal framework also lacks clarity on the obligations of digital platforms towards gig workers, leading to gender inequalities and exploitation. Additionally, the Code fails to address issues such as fluctuating incomes and the impact of social security costs on gig workers’ earnings.

Recent case laws, such as the PIL filed by gig workers before the Supreme Court, highlight the ongoing struggle for social security benefits and fair compensation in the gig economy. The case of All India Gig Workers Union v. Uber India Systems Pvt. Ltd. exemplifies gig workers’ fight for minimum wages and benefits.

In conclusion, there is a pressing need for a comprehensive regulatory framework that safeguards the rights of gig workers in India. By addressing legal vulnerabilities and consulting relevant case laws, India can establish a more secure and equitable digital labor market. Collaboration between legislators, digital platforms, and gig workers is essential to harness the full potential of the gig economy for economic growth and social welfare.
