Liberty Justice Center and Pelican Institute challenge Biden’s LNG export ban
The Liberty Justice Center and Pelican Institute for Public Policy have taken a stand against the Biden administration’s temporary ban on liquefied natural gas (LNG) exports. In a joint effort, they filed a lawsuit challenging the ban, arguing that it violates the Natural Gas Act and exceeds the executive branch’s authority.
The lawsuit contends that the ban undermines the public interest presumption of LNG export applications, as outlined in the Natural Gas Act. It also accuses the administration of overstepping its boundaries by attempting to create law without proper procedure, which could have detrimental effects on the economy.
Loren Seehase, senior counsel at the Liberty Justice Center, emphasized the importance of upholding the rule of law and ensuring that federal officers, including the President, do not have the authority to halt the approval process for LNG exports.
The Biden administration imposed the ban in January, citing the need to review the economic and environmental impacts of LNG export projects. However, 16 Republican-led states have also filed a lawsuit against the ban, arguing that it lacks a factual and legal basis and could harm the US economy.
