Insights from the 2023 Annual Assessment of Continuing Competence: Strengthening Compliance and Client Service in the Legal Profession
The Solicitors Regulation Authority (SRA) has released positive findings from their 2023 Annual Assessment of Continuing Competence, showcasing good practices in the legal profession. The reviews highlighted firms’ effective client service in probate and estate administration, as well as their commitment to professional obligations.
In the probate and estate administration review, many firms were praised for meeting the needs of clients in vulnerable situations, maintaining progress in matters, and demonstrating sensitivity to family dynamics during bereavement. Additionally, firms showed good practices in authorising payments from client accounts, ensuring compliance and trust.
The professional obligations review focused on solicitors’ expertise in legal, regulatory, and ethical areas. The findings emphasized the importance of recognizing the link between client outcomes and compliance, leading to a more proactive approach. While most firms had robust regulatory controls and processes, the SRA identified areas for improvement, urging solicitors to invest more in regulatory and ethical skills.
Paul Philip, Chief Executive of the SRA, emphasized the regulatory requirement of maintaining competence and awareness of professional obligations. He acknowledged good practices in probate management and compliance but stressed the need for further improvements in learning and development practices. The upcoming 2025 review of continuing competence aims to address these areas and drive better compliance and support for solicitors.
