New Law on Telecommunications Set to Take Effect on July 1, 2023

The 2023 Law on Telecommunications is set to revolutionize the telecommunications industry in Vietnam, with its implementation scheduled for July 1 of this year. With 73 articles spread across 10 chapters, the Law aims to digitalize telecommunications infrastructure while creating a fair and transparent legal environment for businesses.

One of the key highlights of the Law is the inclusion of new services such as internet data center (IDC) services, cloud computing services, and over-the-top (OTT) services. These services will be managed under a “light-touch regulation” approach, focusing on protecting users’ rights, ensuring safety and security, and fostering service development.

Notably, the Law will not impose restrictions on foreign ownership for service providers in Vietnam. Businesses looking to offer these new services only need to register or notify authorities, without the need for licenses. They will also be exempt from certain obligations, such as contributing to the Public Telecommunications Service Fund and paying telecommunications operation charges.

In terms of infrastructure development, the Law allows for the construction and installation of telecommunications facilities on public property and encourages shared infrastructure use between project owners and telecommunications companies. It also outlines the responsibilities of building owners for installing telecommunications infrastructure and assigns authorities to handle any obstructions to lawful construction.

Additionally, the Law introduces new obligations for businesses to verify and manage subscriber information, handle incomplete SIM cards, and prevent spam and scam calls. Subscribers are prohibited from using their personal information for others’ contracts without legal permission and will be accountable for registered subscriber numbers.

To promote competition and innovation, the Law includes provisions for managing wholesale telecommunications activities, regulating cross-border services from foreign organizations, and establishing a regulatory sandbox for new technologies and models in the industry.

Overall, the 2023 Law on Telecommunications is expected to drive the growth and development of the telecommunications sector in Vietnam, paving the way for a more competitive and innovative industry landscape.
